EXPLORAMUNT is a virtual travel agency specializing in hiking, mountaineering, and nature tourism, registered on January 16, 2018, in the island register of tourism companies, activities, and establishments of Mallorca and the general register of the Balearic Islands under the name: EXPLORAMUNT, AV/738/BAL. The owner of the EXPLORAMUNT travel agency is David Casajuana Godoy - ID number 43059321D - residing at Placeta de n'Aloi nº3, 07100 Sóller, Balearic Islands, Spain. TERMS AND CONDITIONS Trip Booking:
The consumer makes the trip reservation by sending a "reservation request" via email or regular mail to Exploramunt, or by telephone. Upon request, Exploramunt undertakes to take the necessary steps to obtain confirmation of the reservation based on the number of available places and the requested dates.
In the case of people with reduced mobility, before proceeding with the booking request, they must inform the agency of this situation in order to assess the feasibility of booking the trip according to their characteristics.
Confirmation of booking and payment for the trip:
Once the booking is confirmed by Exploramunt, the package travel contract binds both parties.
Upon confirmation of the booking, the consumer must pay a sum that will in no case exceed 35% of the trip price or, if applicable, supplement any amounts paid as a deposit up to that amount. If the price includes airline tickets, Exploramunt may, in addition to this sum, request payment of the full amount of the airline tickets at the time of confirmation.
The remaining balance of the trip must be paid no later than 20 days before the departure date.
Group tour prices are calculated based on a minimum number of participants. If the minimum number indicated in the trip description is not reached, the price will be adjusted or the trip will be cancelled. Travelers will be notified of any changes at least 10 days in advance.
Payments will be made by bank transfer to the following account: Exploramunt IBAN: ES81 2100 0047 7101 0241 0740 SWIFT: CAIXESBBXXXO or by credit card, requesting this service at the time of payment.
Trip Price Revision: Prices are calculated based on various factors, including exchange rates, transportation fares, fuel costs, and applicable taxes and fees at the time of program publication. Any changes in the price of these factors may result in a revision of the final trip price, up to the amount of the aforementioned price variations. These modifications will be notified to the consumer in writing, who may, if the modification is significant, withdraw from the trip without penalty or accept the contract modification. Under no circumstances will the price be revised upwards within ten days prior to the departure date, based on requests already made. The agency may only revise the price upwards or downwards if such revision is made 20 days prior to departure and is not significant, i.e., exceeding 15% of the trip price. Furthermore, such a revision may only be made to adjust the trip price to variations in: a. Exchange rates applied to the package tour. b. The price of transportation included in the trip, including fuel costs. c. This includes expenses and taxes related to certain services, such as airport taxes, embarkation, disembarkation, and others included in the price. The revised price will be determined based on the equivalent value in the currency of the destination country and the prices, fees, and taxes applicable on the date of publication of the brochure. For tours that include two or more countries, the exchange rate used will be that of the US dollar on the same date. If the price revision represents an increase of 15% or more in the price of the trip, the agency will inform the consumer, who may then terminate the contract. The consumer must notify the agency of their decision within three days of being notified of the change. If the consumer does not communicate their decision within the indicated period, it will be understood that they have opted for termination of the contract. In such a case of contract termination, the consumer may choose to: a. Be refunded within 14 calendar days for all amounts paid. b. Be offered, provided the agency can offer it, another package tour of equal or superior quality. If the proposed trip is of a higher quality, the agency will not charge any supplement. You can also accept a trip of a lower quality, but in this case, the agency will deduct the price difference.
Included and excluded from the trip price: Please refer to the sections of the same name in each trip description. VAT is included in all cases. The following are not included in the price: entry visas, vaccinations, tips, personal equipment, and optional excursions or visits not initially booked. These are not part of the travel contract and are governed by their own terms and conditions.
Withdrawal. Cancellation conditions by the consumer. Withdrawal. At any time, the user or consumer may withdraw from the requested or contracted services, being entitled to a refund of the amounts paid, whether the total price or the advance provided for in the previous section, but must compensate the Organizer or Retailer, except if the withdrawal is due to force majeure, for the items indicated below: A / Management fees: Management fees for booking, total modification (change of all booking names, change of destination, change of travel dates or change of type of sale) and cancellation of the requested services will be applied according to the time elapsed since the creation of the booking, according to the following scale: - Up to 72h after the confirmation of the booking: NO FEES. - From 72 hours to 7 days after booking confirmation: €35 - More than 7 days after booking confirmation: €60 - Bookings confirmed between 7 and 2 days before the start date of the trip will have 24 hours to cancel free of charge. After this period, a €100 administration fee will apply. B / Cancellation fees, if any. C / A penalty of 25% of the total trip cost if the cancellation occurs between 20 and 10 days before the start date of the trip; 50% between 9 and 8 days before the departure date; and 75% within 48 hours of departure. In case of cancellation on the day of departure or no-show, the penalty will be 100%. All amounts and/or items indicated above are cumulative.
Processing of Personal Data By agreeing to these general terms and conditions and signing the travel contract, you consent to the personal data you provide being included in an automated personal data file, the processing of which is the responsibility of EXPLORAMUNT. The purpose of this file is to properly manage the booking and the appropriate provision of the contractual services, as well as the international transfer of this data to the organizing companies and the providers of the aforementioned services, and to send you information about products, services, offers, and promotions related to the program and activities of Exploramunt in the field of hiking, mountaineering, and travel. Your data will not be transferred, solely and exclusively, to third parties who are necessary to provide services related to the purpose of the trip, under contract and for the same purposes mentioned above, safeguarding the duty of confidentiality and applying the security measures required by current regulations. You can exercise your right to object by sending a written document, accompanied by a copy of your valid ID card or passport, by mail to Exploramunt, Placeta de n'Aloi nº3, 07100 Sóller, Spain or to the email address: davidc@exploramunt.com
Collection and Processing of Images for Tourism Promotion Purposes. The concept of personal data includes images when they refer to identified or identifiable individuals. For this reason, current principles regarding the protection of personal data must be applied to the use of cameras, video cameras, and any similar technical means that allow for the capture and/or recording of images during the trip. The dissemination of images will have a promotional purpose, referring both to the company's environment and the tourist attractions of the trip. The client expresses their consent to the capture of images that the guide, other members of the organization, or the clients themselves may take of the group during the trip, authorizing the agency to publish them in the media it deems appropriate for the purposes described above. Exploramunt also informs users that they may exercise their rights of access, rectification, erasure, and objection as provided for in the Spanish Organic Law on Data Protection (LOPD) and other regulations by expressly communicating this to the company. The LOPD does not apply only when the capture and dissemination of images does not affect identified or identifiable individuals.
Insurance: The client is required to have purchased insurance that covers rescue, repatriation, and medical assistance during the trip. We also recommend purchasing cancellation insurance.
